Aviox Cloud – Universal Acceptable Use Policy (AUP)

Aviox Cloud (avioxcloud.com), operated by Aviox Tech Solutions Ltd, maintains an expansive global infrastructure comprising over 150,000 servers across 12 premium data center locations. This Acceptable Use Policy is engineered to provide maximum legal and technical protection for Aviox Cloud, its parent company, upstream data center partners, and third-party software vendors. By utilizing any resource within our ecosystem, you grant your irrevocable consent to these terms. This policy is designed to insulate Aviox Tech Solutions Ltd from liability while granting our administrative team the absolute sovereignty required to maintain a secure, high-performance environment for our global user base.
1. Absolute Administrative Sovereignty and Discretionary Authority
Aviox Cloud reserves the absolute and unilateral right to suspend, terminate, or rate-limit any service, instance, or account at its sole discretion, without prior notice or liability. Our administrative team maintains the final authority to determine what constitutes a violation of this policy. Any activity deemed by Aviox Cloud to be harmful to the network, damaging to our corporate reputation, or disruptive to other tenants will result in immediate mitigation. This discretionary power is fundamental to our ability to react in real-time to emerging security threats and hardware instabilities across our 9 global regions.
2. Third-Party Infrastructure and Data Center Indemnity
Aviox Cloud utilizes high-tier data center partners including, but not limited to, OVHcloud, Equinix, and AWS regions to facilitate our global reach. You expressly acknowledge that Aviox Tech Solutions Ltd is a service manager and reseller of these underlying physical resources. As such, you agree to hold Aviox Cloud and its data center partners harmless for any hardware failures, power outages, or cooling disruptions. Our upstream providers operate under strict ISO/IEC 27001 and SOC2 Type II compliance; however, you acknowledge that Aviox Cloud does not have physical access to these facilities and cannot be held liable for the physical security or operational uptime of the third-party premises.
3. Software Vendor Licensing and Liability Limitation
Our ecosystem integrates professional software from third-party vendors including WebPros (cPanel, WHM, Plesk), DirectAdmin, and LiteSpeed Technologies. By using these tools, you agree to abide by the end-user license agreements of these specific vendors. Aviox Cloud is not responsible for bugs, security vulnerabilities, or sudden price adjustments implemented by these software developers. You acknowledge that software is provided on an "as-is" basis and that any financial or operational loss resulting from third-party software failure is the sole responsibility of the user, with no legal recourse against Aviox Tech Solutions Ltd.
4. Payment Processor Integrity and Chargeback Protocols
We utilize industry-leading payment processors including Stripe and PayPal to handle global transactions. You agree that any attempt to circumvent our Refund Policy via an unauthorized chargeback is a material breach of this AUP. Aviox Cloud utilizes advanced machine learning fraud detection through our processors; any transaction flagged as "High Risk" may be subjected to an immediate hold or cancellation. In the event of a dispute, you grant Aviox Cloud the right to share your account data, IP logs, and service usage history with the payment processor and your banking institution to prove service delivery and combat "Friendly Fraud."
5. Prohibited Content and Material Breach of Contract
The hosting, transmission, or distribution of any material that violates local, national, or international law constitutes an immediate material breach of this agreement. Prohibited content includes, but is not limited to, child sexual abuse material (CSAM), non-consensual intimate imagery, hate speech, extremist propaganda, and any content that facilitates human trafficking or criminal enterprise. Aviox Cloud maintains a zero-tolerance policy for such materials; discovery of such content will lead to an immediate account purge and a permanent ban without the possibility of data recovery or refund. We reserve the right to report such activities to the National Crime Agency (NCA) in the UK or relevant international authorities.
6. Network Integrity and Prohibited Cyber-Warfare Activities
Aviox Cloud infrastructure must not be utilized to engage in any form of cyber-warfare, DDoS attacks, or unauthorized network intrusion. This includes the hosting of "booter" services, IP spoofing scripts, or any software designed to disrupt the BGP routing or DNS stability of the global internet. The operation of open proxies, TOR exit nodes, or public VPN services is strictly prohibited as these configurations pose a significant risk of IP blacklisting and network abuse. Any instance found participating in outbound malicious traffic will be subjected to an "Emergency Kill-Switch" protocol, resulting in immediate network isolation.
7. Technical Resource Governance and Hypervisor Protection
To ensure the stability of our high-density virtualization environments, Aviox Cloud enforces strict resource governance. vCPU, RAM, and NVMe IOPS must be used for legitimate application processing and web delivery only. The use of resources for high-intensity, non-web tasks such as cryptocurrency mining, distributed computing (folding@home), or sustained 100% vCPU utilization on shared threads is classified as resource abuse. Aviox Cloud reserves the right to implement hardware-level "Strangle-Hold" rate-limiting or to terminate processes that create "noisy neighbor" scenarios, ensuring that the hardware performance promised to other tenants is never compromised.
8. Email Integrity and Global SMTP Reputation Management
Aviox Cloud maintains a rigorous stance on outbound email to protect the deliverability of our entire network. The transmission of Unsolicited Bulk Email (UBE) or any form of Spam is strictly forbidden. Users must ensure that all mailing lists are double-opt-in and comply with the UK Data Protection Act, GDPR, and CAN-SPAM regulations. We reserve the right to block Port 25 or implement SMTP filters at our discretion to prevent the blacklisting of our IP blocks. Any account that causes an Aviox Cloud IP to be listed on major RBLs (Real-time Blackhole Lists) will be liable for an "IP Reputation Recovery Fee" to cover the labor costs of delisting and mitigation.
9. Intellectual Property and Mandatory Safe Harbor Compliance
As an infrastructure provider, Aviox Cloud adheres to international safe harbor principles, including the Digital Millennium Copyright Act (DMCA). We do not proactively monitor user content for copyright infringement; however, upon receipt of a valid, legally compliant notice of infringement, we will act expeditiously to remove or disable access to the contested material. The user bears the full legal and financial burden of defending against intellectual property claims. Repeated notices of infringement associated with a single account will result in permanent service termination, as Aviox Cloud will not act as a shield for persistent violators of intellectual property laws.
10. Regulated Industries and Mandatory Licensing Verification
Users operating in specialized or regulated sectors, including online gambling, pharmaceutical sales, financial services, or adult entertainment, are required to maintain all necessary legal licenses for their jurisdiction. Aviox Cloud reserves the right to request proof of licensure at any time. Failure to provide such documentation within 24 hours of a request will result in immediate service suspension. Furthermore, we do not host any "high-risk" financial activities such as unlicensed currency exchanges or high-yield investment programs (HYIPs), as these pose a disproportionate risk of legal and regulatory pressure on our corporate entity.
11. Investigative Rights and Proactive Security Monitoring
While Aviox Cloud respects user privacy, the safety and technical stability of the network are our highest priorities. We reserve the right to monitor network traffic patterns, perform automated malware scans, and investigate server metadata if we detect anomalous activity or receive a credible third-party complaint. You expressly authorize Aviox Cloud to access your instance for the purpose of mitigating a security breach or enforcing this AUP. Such access is conducted under strict internal security protocols and is limited to the extent necessary to protect the infrastructure and other users.
12. Comprehensive Legal Indemnification and Liability Shifting
By utilizing Aviox Cloud services, you agree to fully indemnify, defend, and hold harmless Aviox Tech Solutions Ltd, its directors, employees, upstream data center partners, and software vendors from and against any and all claims, damages, losses, and expenses (including high-tier legal fees). This indemnification covers any third-party claims arising from your content, your breach of this AUP, or your violation of any third-party rights. This clause ensures that the financial burden of your digital activities remains solely with you and does not impact the operational budget or corporate stability of Aviox Cloud.
13. Security Responsibility and Emergency Patching
The Client retains full administrative responsibility for the security and patching of their hosted Operating Systems and applications. If a user instance is found to contain "Zero-Day" vulnerabilities or is unpatched against critical CVEs (Common Vulnerabilities and Exposures), Aviox Cloud reserves the right to force-restart the instance into a "Recovery Mode" or apply emergency security patches at the hypervisor level. We are not liable for any software incompatibility or downtime resulting from these essential security interventions. Clients are encouraged to utilize our Managed Services for proactive security management to avoid such emergency actions.
14. Fair Use Policy for Unlimited and Scalable Plans
Services advertised as having "Unlimited" or "Scalable" resources are subject to a professional Fair Use Policy. These resources are intended for standard business or personal hosting use and may not be utilized for archival storage, file mirroring, or the secondary reselling of disk space. If a user's usage patterns deviate significantly from the average consumption profile of our user base, Aviox Cloud reserves the right to request a migration to a dedicated or private cloud environment at the user's expense. Failure to migrate when requested may result in the implementation of hard caps on the account's throughput or storage capacity.
15. Policy Evolution and Irrevocable Acceptance
Aviox Cloud reserves the unilateral right to amend or update this Acceptable Use Policy at any time to reflect emerging security threats, changes in international law, or updates to our upstream provider agreements. It is the user’s responsibility to check our official website periodically for updates. Continued use of our 12 global data center locations and enterprise software following any policy modification constitutes your irrevocable acceptance of the revised terms. This policy is governed by the laws of England and Wales, and any disputes shall be adjudicated exclusively in the courts of London, United Kingdom.
